We represented a victim that was sexually assaulted at her apartment complex. We sued the apartment owner and its manager for failing to use ordinary care to make their apartment complex safe. Our investigation showed that hundreds of 9-1-1 calls had been made by tenants of the apartment complex in the year prior to our client being assaulted. Many of these 9-1-1 calls were for violent crimes. The apartment complex knew of these crimes and failed to warn our client of the dangers and failed to take reasonable steps to ensure a safe living environment for its tenants and guests. We litigated the case and the defendants tendered the full insurance policy limits of $6,000,000. Continue reading
